In the state of Florida, when a worker becomes injured while working for an employer and that employee is denied benefits, the worker may seek redress through the Office of Compensation Claims.
Typically, the person hires an attorney, and that attorney files a petition for benefits. The employer or insurance carrier, either directly or through an attorney, prepares a response to the petition. The issues may ultimately be decided by a Judge of Compensation Claims. Although state mediation is automatically provided, the parties may seek to opt out of the state system and engage a private mediator, to either resolve the disputed benefits, or to ‘wash out’ the entire claim.
